1. Acceptance of these terms
These Terms of Service (“Terms”) are a binding agreement between you and EditsPack, operated from Tbilisi, Georgia (“EditsPack”, “we”, “us”, “our”), governing your access to https://editspack.onrender.com and any purchase or download of EditsPack Signature (“the Product”).
By creating an account, buying the Product, downloading the Product or otherwise using the site, you accept these Terms. If you do not agree, do not use the site. These Terms incorporate our Privacy Policy, our Refund Policy and — for the license to use the Product itself — our End-User License Agreement, all of which are reachable from the site footer.
2. Eligibility and accounts
You must be at least 13 years old to create an account, and old enough to form a binding contract in your jurisdiction to make a purchase; if you are a minor, a parent or guardian must make the purchase and supervise the account. Accounts are created exclusively by signing in with a Google account (Google OAuth 2.0): your Google email address is your EditsPack identity, and we store the name, email and profile picture URL attached to it.
You agree to sign in only with your own genuine Google account, to keep control of that account, and not to lend, sell or share your EditsPack access with other people. You are responsible for all activity that happens through your account. One person, one account, one license — other members of your team or household need their own purchase.
3. The service
EditsPack sells one product: EditsPack Signature — “The Ultimate Edits Pack” — a digital download in the .drfx installer format containing exactly 1,000 hand-crafted DaVinci Resolve items: shakes, transitions and effects. It is built for DaVinci Resolve (free and Studio) and installs through Resolve’s own template system. DaVinci Resolve itself is made by Blackmagic Design and is not included, licensed, warranted or supported by us; your use of Resolve remains governed by Blackmagic Design’s own terms.
We may improve, correct or extend the Product over time. Any updates we choose to release are described in section 10 of the End-User License Agreement.
4. Purchases, pricing and taxes
The Product is sold for a one-time payment of $10.00 USD. There is no subscription, no recurring charge and no per-project fee. Checkout and payment processing are handled by Payhip, which acts as merchant of record and calculates, collects and remits VAT, GST or sales tax where applicable; the exact price and any tax are shown before you confirm payment on payhip.com.
We never see or store your card details. Your purchase is recorded against the checkout email address and, where you checked out while signed in, linked to your EditsPack account; if you buy first and sign in later, the purchase attaches to the account created with the matching Google email address.
5. Delivery and downloads
The Product is a digital good delivered electronically. After your payment is confirmed, the .drfx file becomes available as a gated download from your EditsPack account — you must be signed in for the download to appear and work. Delivery is complete and your purchase becomes final when the download is made available to your account and you have had the opportunity to download it, as further explained in our Refund Policy.
To protect the file from mass theft and keep bandwidth available for paying customers, each account may download the Product 3 to 5 times in any rolling 24-hour period. If you hit the cap, wait for it to reset and try again. Every gated download is logged (account, file name, byte count, IP address, user-agent) as an anti-piracy audit record, as described openly in our Privacy Policy.
6. License to the Product
Your right to install and use the 1,000 items inside the Product is granted under our End-User License Agreement (EULA), not under these Terms. In one sentence: you receive a perpetual, non-exclusive, non-transferable, single-user license to use the items in unlimited personal and commercial video projects, and you may not resell, redistribute or repackage the raw asset files. Read the full EULA before purchasing — it is linked in the site footer and shown at checkout.
7. Acceptable use and prohibited conduct
You agree not to use the site or the Product in any way that harms EditsPack, our customers or our ability to keep operating. Without limiting that, the following are strictly prohibited:
- Redistributing, reselling, uploading, leaking or sharing the .drfx file or any of its extracted contents, in whole or in part, on file hosts, Discord, Telegram, marketplaces, torrents, “free download” sites or anywhere else.
- Sharing your download links, your account or your sign-in credentials with others, or downloading on behalf of people who have not purchased a license.
- Using bots, scripts, download managers, multiple coordinated accounts or any automated means to scrape the site or bulk-download files.
- Circumventing, testing or attempting to defeat the daily download limit, the gated delivery system, rate limits or any other protective measure.
- Attempting to gain unauthorized access to accounts, admin functions, databases or hosting infrastructure, or probing the site for vulnerabilities without written permission.
- Committing payment fraud, filing abusive or false chargebacks, or misrepresenting purchase information.
- Removing, obscuring or altering any copyright, attribution or license notice shipped with the Product.
Suspected violations may be investigated using the download audit records described in the Privacy Policy.
8. Account suspension and bans
We may suspend or permanently ban an account, and block the associated email address or IP ranges, if we reasonably determine that the account has breached these Terms or the EULA — including license violations, download abuse, scraping, chargeback fraud or account sharing. During suspension, downloads stop working. A banned account loses access to the Product and to any updates, without refund, as set out in the EULA and Refund Policy.
Where the issue is an accident or a misunderstanding, contact us before doing anything else — we are reasonable with customers who are honest with us. We may also restore access on a case-by-case basis if you remove infringing copies of the Product from circulation.
9. Intellectual property
The EditsPack name, the site, its design, its text and all content and code powering it are owned by EditsPack and protected by copyright and other laws. The 1,000 items inside the Product and the .drfx package itself are licensed to you — not sold — under the EULA. Nothing in these Terms transfers ownership of any intellectual property to you. Blackmagic Design and DaVinci Resolve are trademarks of Blackmagic Design Pty Ltd; Google, Google Account and AdSense are trademarks of Google LLC; Payhip is a trademark of its respective owner. EditsPack is not affiliated with or endorsed by Blackmagic Design.
10. Third-party services
The service depends on independent third parties: Google (authentication, and advertising via AdSense if and when ad slots are enabled), Payhip (checkout, payment and tax), and our hosting provider (Render). Each of them has its own terms and policies — Google’s Terms of Service and privacy policy, Payhip’s buyer terms and privacy policy — and your use of them is additionally governed by those documents.
We do not control third-party services and are not liable for their availability, acts or omissions. If a third party changes or discontinues a service we depend on, we may adapt, pause or modify parts of the service accordingly, as described in section 12.
11. Availability
We aim to keep EditsPack available at all times, but we provide it on an as-is, as-available basis. There may be scheduled or unscheduled downtime, maintenance windows, bandwidth pressure or provider outages. If an outage prevents you from downloading a product you paid for, contact tfiruvtr@gmail.com — persistent technical failure that prevents delivery for more than 72 hours is one of the limited situations where a refund may be considered under our Refund Policy.
12. Changes to the service and these Terms
We may modify, add to or discontinue any part of the service, and we may update these Terms from time to time. The “last updated” date at the top of this page shows the current version. Material changes will be announced on the site, and your continued use of the site or the Product after a change takes effect constitutes acceptance of the updated Terms. If a change materially reduces your rights over the Product you already bought, the version of the Terms (and EULA) in effect at the time of your purchase governs your existing license.
13. Disclaimer of warranties
The site and the Product are provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law — including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Product will meet every creative expectation, that every item will suit every project, or that the service will be uninterrupted or error-free. Because Resolve is third-party software, we cannot warrant compatibility beyond the stated target (DaVinci Resolve, free and Studio) and cannot be responsible for changes Blackmagic Design makes to Resolve.
Nothing in this section limits warranties or remedies that cannot lawfully be excluded, including statutory consumer guarantees in your country of residence.
14. Limitation of liability
To the maximum extent permitted by law, EditsPack and its operator will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost project files or lost creative work, arising out of or relating to the site or the Product — even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Product is limited to the amount you actually paid us for the Product — that is, ten U.S. dollars ($10.00 USD) for a standard purchase. Nothing in these Terms excludes or limits liability for gross negligence, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. This limitation applies to the fullest extent permitted by the mandatory consumer-protection law of your country of residence.
15. Indemnification
You agree to indemnify and hold harmless EditsPack and its operator from any third-party claims, demands, investigations, losses, liabilities, damages and reasonable costs (including legal fees) arising out of your breach of these Terms or the EULA, your violation of any law or third-party right, or your redistribution or other misuse of the Product. We reserve the right to assume the exclusive defense of any matter otherwise subject to indemnification by you, in which case you will cooperate with our defense.
16. Termination
You may stop using the site at any time and may request deletion of your account as described in the Privacy Policy — noting that deletion ends your ability to re-download the Product from that account. We may suspend or terminate your access for breach as described in section 8, or immediately where required to prevent ongoing piracy, fraud or security harm. Sections 9, 13, 14, 15, 17 and 18 of these Terms survive any termination, and your EULA license survives termination only if you have complied with it.
17. Governing law
These Terms and any dispute arising out of them or the Product are governed by the laws of Georgia (the country), without regard to conflict-of-law rules. This choice of law does not deprive consumers of the protection of mandatory provisions of the law of their country of residence: if you are a consumer residing in the EEA or the UK, you keep whatever consumer rights the law of your country grants you that cannot be waived, including any right to bring proceedings in your local courts.
18. Dispute resolution
We ask that you contact us first: email tfiruvtr@gmail.com and give us a fair chance to resolve the problem informally — we commit to responding within 30 days. Most disputes end there.
If informal resolution fails, disputes shall be brought before the competent courts of Tbilisi, Georgia, except that consumers may also bring proceedings in their country of residence where the law of that country so requires, and either party may seek urgent injunctive relief (for example against ongoing piracy) in any competent court. The European Online Dispute Resolution platform is no longer available, but EU consumers may use their national ODR or consumer-protection bodies where applicable. Class, collective or representative actions are waived to the extent permitted by applicable law.
19. Severability
If any provision of these Terms is held invalid, illegal or unenforceable, that provision will be narrowed to the minimum extent necessary or severed, and the remaining provisions will stay in full force. A waiver of any breach is not a waiver of any later breach. These Terms, together with the EULA, Privacy Policy and Refund Policy, are the entire agreement between you and EditsPack regarding the Product and supersede any prior understandings. You may not assign your account or license without our written consent; we may assign our rights as part of a reorganization, so long as your consumer rights are preserved.
